1. Scope and Seller
1.1 These Fan & Buyer Terms (“Terms”) apply to purchases made from TrackSet through the TrackSet website, campaign pages and TrackSet-operated shop. They apply to consumers and, unless expressly agreed otherwise, other buyers.
1.2 The seller and contractual counterparty is Erkan Blattner, Ditta Individuale, trading as “TrackSet”, at the contact details above (“TrackSet”, “we”, “us”). The featured artist is not the seller unless a campaign page expressly states otherwise.
1.3 The campaign page, checkout information, order confirmation, these Terms, the Shipping, Refund & Claims Policy and any mandatory consumer information form the contract. If they conflict, mandatory law prevails, followed by the campaign-specific information and then these Terms.
2. Key Definitions
2.1 “Backing” means the customer’s conditional purchase order for a campaign product. “Backer” means the customer placing that order.
2.2 “Campaign” means the 28-calendar-day demand-validation period shown on the relevant campaign page. “Campaign Target” means the number of backed copies displayed for that release.
2.3 “Greenlight” means TrackSet’s discretionary decision to fund or arrange the remaining production requirement even when the Campaign Target is not reached. No public or contractual Greenlight threshold applies.
2.4 “Production Confirmation” means TrackSet’s notice that the product will be manufactured, whether because the Campaign Target was reached or TrackSet issued a Greenlight.
3. Eligibility and Customer Information
3.1 Customers must have legal capacity to enter into the purchase. A minor may order only with the involvement and consent of a parent or legal guardian where required.
3.2 Customers must provide complete and accurate billing, payment, email and delivery information and keep it current until delivery. TrackSet is not responsible for delays or additional costs caused by incorrect information supplied by the customer, subject to mandatory law.
3.3 Products are offered for personal use. TrackSet may apply reasonable per-customer purchase limits and may reject or cancel fraudulent, automated, abusive or clearly commercial bulk orders, refunding amounts received for cancelled items.
4. Product Information and Availability
4.1 The campaign or product page identifies the format, edition, price, Campaign Target, included digital content, estimated production and shipping period, territorial availability and any purchase limit.
4.2 Product images are illustrative. Minor differences in colour, paper tone, print position, material texture or other production characteristics may occur. Such differences do not limit statutory conformity rights where the product materially differs from its description or intended use.
4.3 LIMITED products are sold only in the stated saleable edition. Technical overrun copies may be retained solely for replacements, quality control or archive and are not offered as additional regular LIMITED stock.
4.4 Availability before Production Confirmation is conditional. Adding an item to a basket does not reserve it. TrackSet may correct obvious errors, including manifest pricing or description errors, before accepting an order; the customer may accept the correction or receive a cancellation and refund.
5. Order Process and Contract Formation
5.1 Before submitting an order, the customer can review and correct the selected product, quantity, delivery information, total price and payment method. The checkout button will clearly indicate that the order creates an obligation to pay.
5.2 After submission, TrackSet sends an electronic acknowledgement. For campaign products, the purchase contract is concluded subject to the condition that TrackSet issues a Production Confirmation. The acknowledgement alone does not mean that production is confirmed.
5.3 For immediately available shop products, the contract is accepted when TrackSet sends an order acceptance or dispatch confirmation, whichever occurs first.
5.4 TrackSet stores the order information as required for performance and legal compliance. Customers should retain the order confirmation and these Terms. The available contract language is stated at checkout.
6. Customer Cancellation Before Production Confirmation
6.1 A customer may ask TrackSet to cancel a Backing at any time before Production Confirmation. TrackSet will release any payment authorisation or refund any amount already collected using the original payment method.
6.2 This voluntary campaign cancellation right is additional to, and does not replace, the statutory withdrawal rights described below.
7. Campaign Outcomes
7.1 Campaigns run for 28 calendar days unless the campaign page states a legally permissible correction or extension made before orders are submitted.
7.2 A release may be confirmed in either of two ways:
- the Campaign Target is reached; or
- the Campaign Target is not reached, but TrackSet elects to Greenlight the release and finance or otherwise secure the remaining production requirement.
7.3 TrackSet is never obliged to Greenlight an unsuccessful campaign. The customer accepts that a product may nevertheless be manufactured and the Backing fulfilled when TrackSet issues a Greenlight.
7.4 TrackSet will normally communicate the final outcome promptly after the Campaign ends. If no Production Confirmation is issued within 14 calendar days after the Campaign end, the conditional campaign order is automatically cancelled unless the customer has expressly agreed to a later decision date.
7.5 If production is not confirmed, TrackSet will cancel the order, release any payment authorisation and refund any payment already collected. The customer receives no ownership, profit share, royalty, security, voting right or other investment interest.
8. Prices, VAT and Payment
8.1 The total price shown before checkout includes applicable VAT or similar sales tax where required. Delivery charges and any other mandatory charges are shown separately before the order is submitted.
8.2 For deliveries outside the European Union, import VAT, customs duties, clearance fees or local charges may be payable by the customer unless checkout expressly states that they are included.
8.3 Available payment methods are shown at checkout. Depending on the payment flow displayed there, TrackSet or its payment provider may either authorise the amount and capture it after Production Confirmation or charge it when the Backing is placed.
8.4 If a campaign order is cancelled because production is not confirmed, TrackSet will initiate the release or refund without undue delay and no later than 14 days after cancellation. Bank and card processing times are outside TrackSet’s reasonable control.
8.5 Refunds are made to the original payment method unless the customer expressly agrees otherwise. TrackSet does not pay interest on authorised, held or refunded amounts except where mandatory law requires it.
8.6 TrackSet may use payment service providers. The customer must comply with the provider’s authentication and security requirements. A failed or expired payment may cause the order to be suspended or cancelled after reasonable notice.
9. Discounts and Price Reductions
9.1 Discounts, campaign rewards and bundles apply only under their stated conditions and cannot be exchanged for cash. Where a price reduction announcement is legally regulated, TrackSet will display the required prior reference price.
9.2 A later discount does not create a right to reimbursement of the difference for an earlier completed purchase, without prejudice to mandatory law or a stated price-protection promise.
10. Production and Delivery Estimates
10.1 Campaign products are manufactured only after Production Confirmation. The campaign page states the estimated production period and expected shipping month. Those estimates reflect the information reasonably available when the order is placed.
10.2 Vinyl manufacturing, freight, customs and fulfilment can be delayed. TrackSet will communicate material delays and provide an updated estimate. A delay does not remove the customer’s mandatory rights.
10.3 Where a specific delivery date or period has been agreed, that agreed period replaces the ordinary statutory default period. If TrackSet fails to deliver within the agreed period, the customer may grant a reasonable additional period and, if delivery still does not occur, terminate the contract as provided by applicable consumer law. No additional period is required where the agreed delivery date was essential or TrackSet refuses delivery.
10.4 TrackSet may ship physical and digital parts of an order separately. Partial delivery does not create additional delivery charges unless agreed before purchase.
11. Shipping Address, Carriers and Risk
11.1 The customer must check the delivery address in the confirmation and report corrections promptly. If an order has already been dispatched, address changes may be impossible or may incur actual additional carrier costs.
11.2 TrackSet selects the carrier from the options offered at checkout. Risk of loss or damage passes to a consumer when the consumer, or a third party designated by the consumer other than the carrier, physically receives the goods.
11.3 If the customer independently instructs a carrier not offered by TrackSet, risk may pass when TrackSet hands the goods to that carrier, to the extent permitted by law.
11.4 If a parcel is returned because of an incorrect address, refusal, failure to collect or unpaid import charges, TrackSet will contact the customer. Reasonable documented re-shipping costs may be charged, but statutory refund and conformity rights remain unaffected.
12. Title and Failed Delivery
12.1 Ownership of physical goods passes only after full payment, without affecting the consumer risk-transfer rule above.
12.2 If tracking shows delivery but the parcel was not received, or if a parcel is lost in transit, the customer should contact TrackSet promptly so that TrackSet can investigate with the carrier. The customer’s statutory remedies remain available.
13. Separate Shipping, Refund & Claims Policy
13.1 Operational instructions for address changes, damaged parcels, return labels, packaging, photographs and claim handling are set out in the current Shipping, Refund & Claims Policy.
13.2 That policy cannot reduce the customer’s rights under these Terms or mandatory consumer law. If there is a conflict, the legally more protective rule applies.
14. Statutory Right of Withdrawal — Physical Goods
14.1 A consumer may withdraw from an online contract for physical goods without giving a reason within 14 days from the day on which the consumer, or a designated third party other than the carrier, receives the goods. For multiple goods delivered separately, the period begins on receipt of the last item where applicable.
14.2 To exercise the right, the consumer must send an unequivocal statement before the period expires to TrackSet at Strada Provinciale 72, 74023 Grottaglie (TA), Apulien, Italien or support@trackset.studio.
14.3 After withdrawal, the consumer must return the goods without undue delay and no later than 14 days after communicating withdrawal. Unless TrackSet offered to collect them or applicable law provides otherwise, the consumer bears the direct cost of return.
14.4 The consumer is liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
14.5 TrackSet will reimburse payments received for the withdrawn goods, including the least expensive standard outbound delivery option offered, within 14 days after receiving the withdrawal notice. TrackSet may withhold reimbursement until the goods are returned or the consumer provides evidence of dispatch, whichever occurs first.
14.6 Refunds use the original payment method unless expressly agreed otherwise and do not incur a refund fee charged by TrackSet.
15. Exceptions to Withdrawal
15.1 The withdrawal right does not apply where a statutory exception applies, including:
- sealed audio recordings after the consumer has unsealed them;
- goods made to the consumer’s specifications or clearly personalised; and
- digital content supplied without a tangible medium after performance has begun with the consumer’s prior express consent and acknowledgement that the withdrawal right will be lost, where all legal requirements are met.
15.2 A product is not excluded from withdrawal merely because it is a limited edition, campaign-funded or manufactured in response to aggregate demand. Numbering alone is not treated as personalisation unless the item was individually customised for the customer.
15.3 TrackSet will identify any applicable exception clearly before checkout. Nothing in this section excludes rights concerning defective, damaged or non-conforming goods.
16. Voluntary Pre-Dispatch Cancellation
16.1 TrackSet may accept a cancellation request after Production Confirmation but before dispatch where fulfilment can reasonably be stopped. This voluntary service does not apply where a statutory withdrawal exception has already arisen or where irreversible personalised production has begun.
17. Digital Content
17.1 A campaign page states whether digital content is included or sold. Access method, format, compatibility, release timing and any technical restrictions will be disclosed before purchase where relevant.
17.2 If the customer requests access before the 14-day withdrawal period expires, TrackSet will obtain the customer’s prior express consent to begin performance and acknowledgement that the withdrawal right will be lost once performance begins, where required by law. This requires a separate checkout confirmation and is not inferred merely from acceptance of these Terms.
17.3 Loss of withdrawal rights for digital content does not automatically remove the withdrawal right for a separable physical product. Any price allocation or bundle treatment will be explained at checkout and applied in accordance with mandatory law.
17.4 The customer receives a personal, non-exclusive, non-transferable licence to access the supplied digital content for private use. Copyright and other intellectual-property rights remain with their respective owners. Unauthorised redistribution, resale of files, public upload or commercial exploitation is prohibited.
18. Returns Following Withdrawal
18.1 Returned physical goods should be securely packaged and sent to the return address communicated by TrackSet. The customer should retain proof of dispatch.
18.2 The withdrawal procedure is separate from a defect or transport-damage claim. Customers should not pay return costs for goods returned because they are defective, damaged or not as ordered where TrackSet is legally responsible.
19. Legal Guarantee and Conformity
19.1 Consumers receive the mandatory legal guarantee for conformity. For new goods in the European Union this is generally at least two years from delivery, subject to the consumer’s applicable mandatory national law.
19.2 Goods must match their description, type, quantity and quality and have the functionality, compatibility, durability and other characteristics that a consumer may reasonably expect, taking account of the product page and public statements.
19.3 If goods are non-conforming, the consumer is entitled to the remedies provided by applicable law, which may include repair or replacement, an appropriate price reduction or termination and refund. Because vinyl records are ordinarily not repairable, replacement will normally be the first practical remedy where available, without restricting statutory choices.
19.4 Minor characteristics inherent in vinyl production — such as insignificant cosmetic variation that does not affect playback or the promised edition — are not automatically defects. Material warping, repeated skipping, substantial pressing noise, incorrect content, serious print damage or other lack of conformity remains covered.
19.5 Any commercial warranty offered by a manufacturer is additional to, and does not replace, the legal guarantee owed by the seller.
20. Reporting Problems
20.1 Customers should contact TrackSet as soon as reasonably possible after discovering loss, damage, incorrect delivery or a defect and provide the order number and useful evidence such as photographs or a short playback video. A requested notification period is for efficient investigation and does not waive mandatory rights if missed.
21. TrackSet’s Right to Cancel or Suspend
21.1 TrackSet may cancel or suspend an order where payment fails, the order is fraudulent or abusive, the product becomes unlawful, required music rights are unavailable, production becomes objectively impossible, or a manifest error cannot reasonably be corrected.
21.2 If TrackSet cancels for a reason not caused by the customer, TrackSet will refund the affected product and any related delivery charge paid for an undelivered item. This does not limit any additional mandatory remedy.
22. Liability
22.1 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, wilful misconduct, gross negligence, or mandatory consumer rights.
22.2 Subject to section 22.1, TrackSet is responsible for foreseeable loss and damage caused by its breach of contract or failure to use reasonable care. A loss is foreseeable if it was an obvious consequence or was contemplated by both parties when the contract was made.
22.3 TrackSet is not responsible for business losses suffered by a consumer, including lost profit, revenue, business opportunity or data, where the product was purchased for private use.
22.4 Nothing in these Terms limits the customer’s obligation to take reasonable steps to avoid or reduce preventable loss.
23. Events Beyond Reasonable Control
23.1 TrackSet is not liable for delay or failure caused by events beyond its reasonable control, including pressing-plant shutdown, carrier disruption, material shortage, industrial action, natural disaster, epidemic, war, government action, customs interruption, cyberattack or widespread infrastructure failure.
23.2 TrackSet will take reasonable steps to reduce the effect, communicate material delays and resume performance. If the event causes excessive delay, the customer retains any right to terminate under mandatory law or section 10.3.
24. Intellectual Property and Permitted Use
24.1 Music, recordings, artwork, photographs, text, logos, campaign materials and website content are protected by intellectual-property rights belonging to TrackSet, the artist or other licensors.
24.2 Purchase of a product does not transfer copyright or commercial exploitation rights. Customers may use physical and digital products privately and may resell a lawfully acquired physical copy where applicable law permits. Digital files may not be copied or redistributed beyond legally permitted private use.
25. Personal Data
25.1 TrackSet processes personal data for orders, payment, fraud prevention, delivery, support, legal compliance and, where consent or another lawful basis applies, marketing. Further information is contained in the TrackSet Privacy Policy and Cookie Policy.
25.2 Payment providers, carriers, fulfilment partners and other processors may receive the data necessary to perform their services. These Terms do not constitute consent to optional marketing.
26. Complaints and Alternative Dispute Resolution
26.1 Customers should first contact TrackSet at support@trackset.studio, quoting the order number and a concise description of the issue. TrackSet will seek to respond within a reasonable time.
26.2 If a complaint cannot be resolved directly, consumers may consult the European Commission’s current list of notified consumer alternative-dispute-resolution entities at consumer-redress.ec.europa.eu/dispute-resolution-bodies. TrackSet will provide information about a competent ADR entity where it is legally required or has agreed to participate.
26.3 The former European Online Dispute Resolution platform was discontinued on 20 July 2025 and is therefore not referenced as an active complaint platform in these Terms.
27. Governing Law and Jurisdiction
27.1 These Terms and the contract are governed by Italian law. If the customer is a consumer habitually resident in another country, this choice does not deprive the customer of mandatory protections that apply under the law of that country.
27.2 A consumer may bring proceedings in any court competent under mandatory consumer-jurisdiction rules, including the courts of the consumer’s domicile where applicable. No clause in these Terms requires a consumer to litigate exclusively at TrackSet’s business seat where such a requirement would be unlawful.
27.3 For a buyer acting exclusively in a professional or commercial capacity, the courts at TrackSet’s business seat have exclusive jurisdiction unless mandatory law provides otherwise.
28. General Terms
28.1 If any provision is invalid or unenforceable, the remaining provisions continue in effect. The invalid provision will be applied only to the maximum lawful extent; it will not be replaced by a term that unfairly disadvantages a consumer.
28.2 A delay in enforcing a right is not a waiver. Customers may not transfer contractual rights or obligations without TrackSet’s consent, except where mandatory law allows it. TrackSet may transfer the contract as part of a business transfer only where this does not reduce consumer rights.
28.3 TrackSet may update these Terms for future orders. The version accepted when an order is placed continues to govern that order unless a legally required or customer-beneficial change applies.
28.4 These Terms are drafted in English. Where TrackSet provides another-language version, the version designated at checkout governs, subject always to mandatory consumer-law interpretation and transparency requirements.
